Section 1101.704 - Penalty to Be Paid or Hearing Requested(a) Not later than the 20th day after the date the person receives the notice under Section 1101.703, the person may:(1) accept the executive director's determination, including the recommended administrative penalty; or(2) request in writing a hearing on the occurrence of the violation, the amount of the penalty, or both.(b) If the person accepts the executive director's determination, or fails to respond in a timely manner to the notice, the commission by order shall approve the determination and order payment of the recommended penalty or impose the recommended sanction.Tex.
