Section 202.604 - Civil Penalty: Use of Trade Name; Injunction(a) A person who violates Section 202.352 or a rule adopted or a determination made by the commission under that section is subject to a civil penalty of not less than $50 or more than $500 for each day of violation.(b) If it appears that a person has violated or is violating Section 202.352 or a rule adopted or determination made by the commission under that section, the department may institute a civil action in district court for:(1) injunctive relief to restrain the person from continuing the violation;(2) the assessment and recovery of a civil penalty under Subsection (a); or(3) both injunctive relief and the civil penalty.(c) At the request of the department, the attorney general shall institute and conduct the action in the name of the state.Amended by Acts 2017, Texas Acts of the 85th Leg. - Regular Session, ch. 282,Sec. 60, eff. 9/1/2017.
