Section 51.355 - License Eligibility of Person Whose License Has Been Revoked(a) Except as otherwise provided by this section, a person whose license has been revoked by order of the commission or executive director is not eligible for a new license until the first anniversary of the date of the revocation.(a-1) Subsection (a) does not apply to a person whose license was revoked under Section 455.251(b)(1). (a-2) This subsection and Subsection (a-1) expire September 1, 2025. (b) Notwithstanding Subsection (a), a person whose license has been revoked by order of the commission or executive director is eligible to apply for a new license before the first anniversary of the date of the revocation if: (1) the revocation was based solely on the person's failure to pay an administrative penalty; and(2) the person: (A) has paid the administrative penalty in full; or(B) is paying the administrative penalty under a payment plan with the department and is in good standing with respect to that plan.Amended by Acts 2023, Texas Acts of the 88th Leg.- Regular Session, ch. 13,Sec. 1, eff. 5/13/2023, app. Subsection (a-1) only with respect to a license revoked under Section 455.251(b)(1), Occupations Code, as that section existed immediately before the effective date of this Act.Amended by Acts 2019, Texas Acts of the 86th Leg.- Regular Session, ch. 765,Sec. 1, eff. 9/1/2019.Added by Acts 2009, 81st Leg., R.S., Ch. 669, Sec. 9, eff. 9/1/2009.
