Section 51.053 - Commission Membership; Eligibility(a) Each member of the commission must be a representative of the general public.(b) A person is not eligible for appointment as a member of the commission if the person or the person's spouse: (1) is regulated by the department;(2) is employed by or participates in the management of a business entity or other organization regulated by or receiving funds from the department;(3) owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization regulated by or receiving funds from the department;(4) uses or receives a substantial amount of tangible goods, services, or funds from the department, other than compensation or reimbursement authorized by law for commission membership, attendance, or expenses; or(5) is an employee of the department.(c) Notwithstanding any other law, a person may be a member of the commission if the person or the person's spouse is registered, certified, or licensed by a regulatory agency in the field of health care.Amended by Acts 2021, Texas Acts of the 87th Leg. - Regular Session, ch. 663,Sec. 1.02, eff. 9/1/2021.Amended By Acts 2003, 78th Leg., ch. 816, Sec. 1.004, 1.026, eff. 9/1/2003.Amended by Acts 2001, 77th Leg., ch. 836, Sec. 8, eff. 6/14/2001 Acts 1999, 76th Leg., ch. 388, Sec. 1, eff. 9/1/1999.
