Section 2033.013 - Touting(a) A person commits an offense if, with an intent to deceive and an intent to obtain a benefit, the person knowingly:(1) makes a false statement about a horse or greyhound race to another person; or(2) offers, agrees to convey, or conveys false information about a horse or greyhound race to another person.(b) Except as provided by Subsection (c), an offense under this section is a Class A misdemeanor.(c) An offense under this section is a state jail felony if:(1) the actor:(A) is a license holder under this subtitle or a commission member or employee; and(B) knowingly represents that a commission member or employee or a person licensed by the commission is the source of the false information; or(2) the false statement or information was contained in racing selection information provided to the public.Tex.
