Section 88.0531 - Criminal Penalty(a) A person who knowingly violates Section 88.052 or 88.053 of this code commits an offense.(b) An offense under this section is a Class A misdemeanor unless the actor has been convicted previously under this section, in which event the offense is a felony of the third degree.Tex.
