Section 63.1813 - Mitigation for Damage, Destruction, or Removal of Dune or Dune Vegetation Without Permit
(a) The commissioner may order restoration for the damage, destruction, or removal of a sand dune or a portion of a sand dune or the killing, destruction, or removal of any vegetation growing on a sand dune seaward of the dune protection line or within a critical dune area in violation of this chapter or any rule, permit, or order issued under this chapter.
(b) The decision to require restoration under this section is discretionary with the commissioner. This section does not impose a duty on the state to order restoration.
(c) The commissioner may contract for the restoration required under this section and may pay the costs of restoration from money appropriated by the legislature.
