Section 352.058 - Subrogation(a) By providing a person rehabilitation services, including medical care services, under this subchapter, the commission is subrogated to the person's right of recovery from:(2) another person for personal injury caused by the other person's negligence or wrongdoing; or(b) The commission's right of subrogation is limited to the cost of the services provided.(c) The commission may totally or partially waive the commission's right of subrogation when the commission finds that enforcement would tend to defeat the purpose of rehabilitation.(d) The commission may adopt rules for the enforcement of the commission's right of subrogation.Added by Acts 2015, Texas Acts of the 84th Leg. - Regular Session, ch. 1138,Sec. 25, eff. 9/1/2015.
