Section 541.303 - Sanction(a) The department may report to the attorney general a person's failure to comply with the department's requirement to refund premiums within the time specified under Section 541.302. The department may request that the attorney general file an action to enforce the department's requirement to refund premiums.(b) Venue for the action is in a district court in Travis County.(c) The court shall enter an appropriate order to enforce the department's requirement to refund premiums if the court finds that: (1) the requirement was lawfully entered; and(2) the person failed to comply with the requirement.(d) The court may enforce its order through contempt proceedings.(e) The sanction provided by this section is in addition to any other sanctions provided in this code or other applicable laws.Added by Acts 2003, 78th Leg., ch. 1274, Sec. 2, eff. 4/1/2005.
