Section 541.110 - Administrative Penalty(a) A person who violates a cease and desist order issued under Section 541.108 is subject to an administrative penalty under Chapter 84.(b) In determining whether a person has violated a cease and desist order, the department shall consider the maintenance of procedures reasonably adapted to ensure compliance with the order.(c) An administrative penalty imposed under this section may not exceed: (1) $1,000 for each violation; or(2) $5,000 for all violations.(d) An order of the department imposing an administrative penalty under this section applies only to a violation of the cease and desist order committed before the date the order imposing the penalty is issued.Added by Acts 2003, 78th Leg., ch. 1274, Sec. 2, eff. 4/1/2005.
