Section 101A.154 - Provision of Services(a) Support services shall include:(2) homemaking assistance, including personal care;(3) residential repair and modification;(7) education and training for caregivers;(8) home-delivered meals;(10) other appropriate services identified by the case manager and client through the assessment and care planning process.(b) A case manager shall conduct an individual assessment of an elderly person's needs and shall, in consultation with the elderly person and the elderly person's family, create a plan of care that specifies the type, amount, frequency, and duration of support services the elderly person needs.(c) A plan of care must coordinate the available public and private services and resources that are most appropriate to meet the elderly person's needs.(d) An area agency on aging may not directly provide homemaker, home health, residential repair, respite, meal delivery, or transportation service unless the area agency: (1) receives no response to a request for proposals that meets department standards; and(2) has exhausted all other procurement options available under department rules.(e) An area agency on aging that wants to provide directly a service not available through a local public or private entity must obtain approval from the department in accordance with department rules governing the granting of such approval.Tex.
