Section 433.092 - Failure to Report; Civil Penalty(a) If a person required by this chapter to file an annual or special report does not file the report before the deadline for filing set by the department and the failure continues for 30 days after notice of the default, the person forfeits to the state $100 for each day the failure continues.(b) An amount due under this section is payable to the state treasury and is recoverable in a civil suit in the name of the state brought in the district court of the county in which the person's principal office is located or in which the person does business.(c) Each district attorney, under the direction of the attorney general, shall prosecute for the recovery of an amount due under this section.Tex.
