Section 252.064 - Civil Penalty(a) A person who violates this chapter or a rule adopted under this chapter is liable for a civil penalty of not less than $100 or more than $10,000 for each violation if the department determines the violation threatens the health and safety of a resident.(b) Each day of a continuing violation constitutes a separate ground for recovery.(c) On request of the department, the attorney general may institute an action in a district court to collect a civil penalty under this section. Any amount collected shall be remitted to the comptroller for deposit to the credit of the general revenue fund.Tex. Health and Safety Code § 252.064
