Tex. Health & Safety Code § 65.151

Section 65.151 - Eligibility Criteria
(a) Except as provided by Subsection (b), an individual is eligible for benefits under the program if the individual is:
(1) a resident of this state;
(2) a citizen or lawful permanent resident of the United States; and
(3) uninsured, as determined by the commission.
(b) If the commission determines necessary, the commission may consider an applicant's financial vulnerability as an additional factor for determining program eligibility.
