Section 130.090 - Remedial Programs for Secondary School Students(a) The governing board of a junior college district may contract with the governing board of an independent school district in the junior college district's service area for the junior college to provide remedial programs for students enrolled in secondary schools in the independent school district in preparation for graduation from secondary school and entrance into college.(a-1) The governing board of a junior college district located wholly or partly in a county with a population of more than three million may contract to provide remedial programs under Subsection (a) with the governing board of any independent school district located wholly or partly in a county with a population of more than three million.(b) The governing board of a junior college district may exempt from tuition a student enrolled in a remedial program provided under Subsection (a).(c) The grant of an exemption from tuition under Subsection (b) does not affect the right of a junior college to an allocation of state appropriations under this chapter and Chapter 130A attributable to the contact hours of the junior college with the student receiving the exemption. (d) For instances when state funding is provided to both a school district and a public junior college for a student enrolled in courses offered by a junior college under Subsection (a), the commissioner of education and the commissioner of higher education shall jointly develop a mechanism to identify and eliminate duplication of state funding.Tex.
