Section 45A.158 - [Effective 1/1/2025] Attorney Representing State Not Present For Trial

If an attorney representing the state is not present when the case is called for trial, the justice or judge may:

(1) postpone the trial to a specified date;
(2) appoint an attorney pro tem as provided by this code to represent the state; or
(3) proceed to trial. (Code Crim. Proc., Art. 45.031.)
