The auditor general be and he is hereby authorized and required to examine all cases of penalties, incurred under the third section of the act, to which this is a supplement, and upon payment of all taxes due to the commonwealth, by any of the parties incurring the same, the collection of the penalty therein named, shall be suspended, upon payment of costs by defendant.
