Section 1261.1 - State-owned canal properties may be utilized for park purposes; Secretary may sell waters of canal; State-owned canal properties may be transferred to Department of Highways

The Secretary of Forests and Waters is hereby authorized to utilize for park purposes such parts of canal properties which may heretofore have been or may hereafter be acquired by the Secretary of Forests and Waters in the name of the Commonwealth: Provided, That in connection with such use, the Secretary of Forests and Waters may sell for industrial or domestic purposes the waters of the canal to the same extent to which such waters may heretofore have been sold or utilized for such purposes. The Secretary of Forests and Waters may transfer to the Department of Highways such part of such property as he may deem undesirable to retain under the control of his department: Provided, however, That such transfers shall be made with the approval of the State Parks Commission. The Secretary of Highways is hereby authorized and directed to accept such property for the purposes of location, relocation, construction or reconstruction, and maintenance and repair of highways, and purposes incidental thereto. Upon such transfer, the Department of Forests and Waters shall be relieved of all control over or responsibility for such property.
