Section 751-34 - Reorganization Plan No. 7 of 1981-Pennsylvania Volunteer Loan Assistance Program-Transfer

Section 1. The Pennsylvania Volunteer Loan Assistance Program and the powers and duties of the Department of Community Affairs as set forth in the act of July 15, 1976 (P.L. 1036, No. 208), entitled "An act authorizing the indebtedness, with the approval of the electors, of ten million dollars for loans to volunteer fire companies, volunteer ambulance services and volunteer rescue squads for the purpose of establishing or modernizing facilities to house fire fighting apparatus equipment, ambulances, and rescue vehicles, and for purchasing new fire fighting apparatus equipment, ambulances, and rescue vehicles, protective and communications equipment, and any other accessory equipment necessary for the proper performance of such organizations' duties," are hereby transferred from the Department of Community Affairs to the Pennsylvania Emergency Management Agency.

Section 2. There are hereby transferred to the Pennsylvania Emergency Management Agency, to be used, employed and expended in connection with the functions, powers and duties transferred by section 1 of this Reorganization Plan, personnel, contractual obligations, if any, mortgages, liens, encumbrances, and any other secured interests, records, files, property, supplies and equipment now being used or held in connection with such functions, powers and duties, and the unexpended balance of appropriations, allocations and other funds available or to be made available for use in connection with such functions, powers and duties.

Section 3. The following act is suspended insofar as it conflicts with this Reorganization Plan: The act of July 15, 1976 (P.L. 1036, No. 208), entitled "An act authorizing the indebtedness, with the approval of the electors, of ten million dollars for loans to volunteer fire companies, volunteer ambulance services and volunteer rescue squads for the purpose of establishing or modernizing facilities to house fire fighting apparatus equipment, ambulances, and rescue vehicles, and for purchasing new fire fighting apparatus equipment, ambulances, and rescue vehicles, protective and communications equipment, and any other accessory equipment necessary for the proper performance of such organizations' duties."
