Section 751-31 - Reorganization Plan No. 4 of 1981-Governor's Council on Drug and Alcohol Abuse-Transfer of powers and duties

Section 1.

(a) The Governor's Council on Drug and Alcohol Abuse, together with its powers, functions and duties as set forth in the act of April 14, 1972 (P.L. 221, No. 63), known as the "Pennsylvania Drug and Alcohol Abuse Control Act," the act of April 14, 1972 (P.L. 233, No. 64), known as "The Controlled Substance, Drug, Device and Cosmetic Act," and75 Pa.C.S. § 101 et seq., (relating to vehicles), is transferred from the Governor's Office to the Department of Health. Those powers, functions and duties will be performed by the Department of Health.
(b) The council will be an advisory body, located within the Department of Health. The function of the council will be to provide advice and consultation to the Secretary of Health on the prevention, intervention and treatment of drug and alcohol abuse and dependence. The Department of Health shall seek the advice and consultation of the council in the following areas:
(1) The development and implementation of the State plan for the control, prevention, intervention, treatment, rehabilitation, research, education and training aspects of drug and alcohol abuse and dependency problems.
(2) The promulgation by the Department of Health of any regulations necessary to carry out the purposes of the Pennsylvania Drug and Alcohol Abuse Control Act.
(3) The establishment of funding priorities for drug and alcohol programs.
(4) The allocation of funds for the control, prevention, intervention, treatment, rehabilitation, research or training aspects of drug and alcohol abuse and dependency problems.
(5) Policies pertaining to the collection and dissemination of data and statistics pertaining to drug and alcohol abuse and dependency.

The council within its discretion or at the request of the Department of Health may also provide advice and consultation to the department on any other matter relating to the implementation and coordination of activities under the act.

Section 2. There are hereby transferred to the Department of Health to be used, employed and expended in connection with the functions, powers and duties transferred by section 1 of this reorganization plan, contract obligations, if any, records, files, property, supplies, personnel and equipment now being used or held in connection with such functions, powers and duties, and the unexpended balances of appropriations, allocations and other funds available or to be made available for use in connection with such functions, powers and duties.

Section 3. The act of April 14, 1972 (P.L. 221, No. 63), known as the "Pennsylvania Drug and Alcohol Abuse Control Act," the act of April 14, 1972 (P.L. 233, No. 64), known as "The Controlled Substance, Drug, Device and Cosmetic Act," and 75 Pa.C.S. § 101 et seq., (relating to vehicles), are suspended insofar as they conflict with this reorganization plan.

Section 4. All functions, powers and duties transferred to the Governor's Council on Drug and Alcohol Abuse by Reorganization Plan No. 4 of 1973 (May 22, 1973) and Reorganization Plan No. 2 of 1977 (June 6, 1977) are hereby transferred from the council to the Department of Health. Reorganization Plan No. 4 of 1973 and Reorganization Plan No. 2 of 1977 are suspended insofar as they conflict with this reorganization plan.

Section 5. This reorganization plan shall take effect on July 1, 1981.
