(a)Whoever violates any provision of this act is guilty of a misdemeanor, shall be prosecuted by the board or its agents and, upon conviction, shall be sentenced to imprisonment for not more than six months or to pay a fine of not less than $100 nor more than $1,000, or both. Each violation shall be deemed a separate offense. Fines collected under the provisions of this act shall be paid into the State Treasury for the use of the Commonwealth.(b) In addition to any other civil remedy or criminal penalty provided for in this act, the board, by a vote of the majority of the maximum number of the authorized membership of the board as provided by law, may levy a civil penalty of up to $10,000 on any current licensee who violates any provision of this act or on any person who practices as a speech-language pathologist or audiologist or holds himself forth as a speech-language pathologist or audiologist without being properly licensed to do so under this act. The board shall levy this penalty only after affording the accused party the opportunity for a hearing as provided in 2 Pa.C.S.
