Section 601.505 - Penalties(a) Any person who violates any provisions of the act is guilty of a summary offense and, upon conviction thereof, shall be sentenced to pay a fine of not more than $300 or undergo imprisonment of not more than 90 days, or both. Each day's continuance of such violation shall be a separate and distinct offense.(b) Any person who willfully violates any provisions of this act or any order of the department issued pursuant to the provisions of this act is guilty of a misdemeanor and, upon conviction thereof, shall be sentenced to pay a fine of not more than $5,000 or undergo imprisonment of not more than one year, or both. Each day's continuance of such violation shall be a separate distinct offense.(c) The department shall have the authority to institute prosecutions against any person or municipality under this act.1984, Dec. 19, P.L. 1140, No. 223, § 505, effective in 120 days.
