Section 56302-A - Powers and duties; agreement(a)General rule.--The powers and duties of the township manager shall be regulated by ordinance. The board of commissioners may delegate, subject to recall, any of their nonlegislative and nonjudicial powers and duties to the township manager.(b)Scope of agreement and validity.--(1) The board of commissioners may enter into an employment agreement or professional services agreement with the township manager that specifies the terms and conditions of the appointment.(2) The agreement may remain in effect for a specified period terminating no later than the date of the board of commissioners' organizational meeting following the next municipal election.(3) An agreement with a township manager executed on or after a municipal election but before the first meeting in January the year after the municipal election shall be void.(4) An agreement entered into under this section may specify conditions under which a township manager who is an individual would be entitled to severance compensation, or, in the case of a partnership, limited partnership, association or a professional corporation, payments for the termination of the appointment. In no event may the agreement guarantee retention or employment through the term of the agreement or confer upon the township manager a legal remedy based on specific performance.(c)Status as public official.--The township manager, if an individual, and, in the case of a partnership, limited partnership, association or a professional corporation appointed as the township manager, all officers and those employees directly providing services as required or authorized by the agreement, shall be considered a public official for purposes of the provisions of 65 Pa.C.S. § 1103 (relating to restricted activities).1931, June 24, P.L. 1206, No. 331, art.
