A township commissioner who, by vote, appoints an individual to the police force or as a firefighter contrary to the provisions of this subdivision, or a township commissioner or member of the commission who willfully refuses to comply with or conform to the provisions of this subdivision, commits a misdemeanor and, upon conviction, shall be sentenced to pay a fine not exceeding five hundred dollars ($500) or to imprisonment not exceeding ninety days, or both.
