Section 15568 - Elections; holding; questions to be submitted

Before any city of the first class shall actually enter upon, take, and appropriate properties, facilities, and franchises sought to be condemned under this act, and before it shall tender or file its bond as hereinafter provided, the city shall first obtain the assent of the electors to such condemnation. The question shall be submitted to the electors at the time, in the manner, and under the requirements provided by law with respect to elections for the purpose of obtaining the assent of the electors to the increase of the indebtedness of such city when such assent is necessary; and the question to be submitted to the electors at such election shall be whether they will assent to the incurring or increase of the debt, in the amount which shall be stated, for the purpose of the condemnation of such properties, facilities, and franchises, which purpose shall be briefly indicated and, if the consent of the court to the deduction of the amount to be so borrowed from the city's debt in calculating its borrowing power shall have been first obtained, that fact shall be stated in the notice of the election required to be given by section five, of article eighteen of the act, approved June twenty-fifth, one thousand nine hundred and nineteen, entitled "An act for the better government of cities of the first class of the Commonwealth of Pennsylvania." The assent of a majority of the electors of such city voting upon the question shall be a condition precedent to the consummation of such condemnation and taking.
