Section 895.1101 - Scope of chapter(a)Applicability.--This chapter shall apply to a local government which does not have a deferred retirement option plan on the effective date of this section.(b)Elected officials.--(1) A deferred retirement option plan established on or after the effective date of this paragraph shall not be available to an elected official.(2) A deferred retirement option plan established prior to the effective date of this paragraph shall be available to an official elected prior to the effective date of this section who runs for reelection. 1984, Dec. 18, P.L. 1005, No. 205, § 1101, added 2009, Sept. 18, P.L. 396, No. 44, § 19, imd. effective.
