Section 11704.6 - Local authoritySubject to the provisions of this act and applicable Federal and State laws and regulations, nothing in this act shall be construed to:
(1) Limit or preempt the scope of a municipality's zoning, land use, planning, streets and sidewalks, rights-of-way and permitting authority as it relates to small wireless facilities.(2) Grant the authority to a municipality to exercise zoning jurisdiction over the design, engineering, construction, installation or operation of a small wireless facility located in an interior structure or on the site of a campus, stadium or athletic facility not owned or controlled by the municipality. Nothing in this act authorizes the Commonwealth or any municipality to require small wireless facility deployment or to regulate wireless services. 2021, June 30, P.L. 232, No. 50, § 6, effective in 60 days [Aug. 30, 2021].
