Section 4001.2 - Exclusion(a)General rule.--Except as provided in subsection (b), a political subdivision shall not be subject to requirements of advertising and bidding otherwise imposed by law for the sale of personal property owned by the political subdivision when selling recyclable material or material separated, collected, recovered or created by a recycling program authorized by the political subdivision.(b)Exception.--The exclusion set forth in subsection (a) shall not apply to a contract entered into between a political subdivision and a private entity for the purpose of carrying out a recycling program on behalf of the political subdivision. 1992, April 9, P.L. 70, No. 21, § 2, imd. effective.
