Section 1301.202 - Piece rates
(a) Notwithstanding the provisions of section 201 , an employer of seasonal farm labor may adopt a piece rate or rates, or differential piece rate or rates, as a basis for, or a partial or additional basis for, the compensation of seasonal farm workers in his employment: Provided, That any such piece rate or rates, or differential piece rate or rates, shall yield to each seasonal farm worker in his employment, in each and every workweek, not less than the applicable minimum hourly wage rate which such seasonal farm worker would have received pursuant to the provisions ofsection 201 in the same workweek.
(b) Every employer of seasonal farm labor who adopts a piece rate or rates, or differential piece rate or rates, as a basis for, or a partial or additional basis for, the compensation of seasonal farm workers in his employment, shall apply such piece rate or rates to the work done by every minor in his employment in the same manner as such rates are applied to adult workers, and shall compensate such minor at such rates as they are applied to work done by adult workers, subject to the minimum wage provisions of section 201.
