Section 2233 - Appointment of viewers; damages

If the authorities responsible for the maintenance of the public road, highway or turnpike shall not be able to enter into an agreement with the owner of adjacent property occupied by such snow fence as to the amount of damages sustained as a result of said fence being placed and removed, the owner may petition the court of the proper county for the appointment of viewers to ascertain the amount of damage incurred in such case. The appointment of viewers shall be governed and be in accordance with existing laws relative to the appointment of viewers for the ascertaining of damages to private property due to a relocation of a state highway. Such damages, if any, when ascertained, shall be paid by the authorities responsible for the maintenance of the public road, highway or turnpike, and any funds available to the Department of Highways or any county of the first class or township for the construction and maintenance of public roads, highways or turnpikes under their supervision shall be available for the payment of such damages. The maintenance fund available to the Pennsylvania Turnpike Commission for the maintenance of the Turnpike, or any extension thereof, or any connecting roads constructed by the Pennsylvania Turnpike Commission, shall be available for the payment of such damages.
