Section 10231.1304 - Criminal diversion of medical marijuana by patient or caregiver(a)Offense defined.--In addition to any other penalty provided by law, a patient or caregiver commits an offense if the patient or caregiver intentionally, knowingly or recklessly provides medical marijuana to a person who is not lawfully permitted to receive medical marijuana.(b)Grading.--A first offense under this section constitutes a misdemeanor of the second degree.
