Section 2164 - Penalty
(a) Any person operating a clinical laboratory without first having obtained a permit from the department or violating the provisions of section 13.1 of the act shall, upon conviction thereof, be sentenced to pay a fine not exceeding five hundred dollars ($500) or to imprisonment not exceeding one (1) year, or both.
(b) In addition to any other penalty that may be imposed by the department, the department may assess a civil penalty of up to five hundred dollars ($500) per day on a person or clinical laboratory that engages in any of the following:
(1) Violates the provisions of this act or the department's regulations.
(2) Operates a clinical laboratory within this Commonwealth without a permit from the department.
(3) Performs testing without a permit from the department on any specimen accepted or collected within this Commonwealth.
(c) Moneys received from civil penalties imposed by the department on a person or clinical laboratory shall be paid into the State Treasury and shall be credited to the general government appropriations of the department for administering and enforcing the provisions of this act.
