Section 13-1310.1 - Classroom placement of twins or higher order multiples; parental discretion(a) For the 2008-2009 school year and each school year thereafter, a parent or guardian of twins or higher order multiples in the same grade level at the same school may request that their children be placed in the same classroom or in separate classrooms. The school may recommend classroom placement to the parents and provide professional education advice to the parents to assist them in making the best decision for their children's education. Except as provided in subsections (b) and (c), a school shall provide the classroom placement of twins or higher order multiples requested by the children's parent or guardian, unless, after consultation with the school district superintendent or the superintendent's designee, the principal determines that alternative placement is necessary. The parent or guardian must request the classroom placement no later than ten (10) days after the first day of each school year or ten (10) days after the first day of attendance of the children during a school year if the children are enrolled in the school after the school year commences.(b) If the principal of the school, in consultation with the teacher of each classroom in which the twins or higher order multiples are placed, determines that the requested classroom placement is disruptive to the classroom, the principal may determine the appropriate classroom placement for the siblings.(c) A school district is not required to place twins or higher order multiples in separate classrooms if the request would require the school district to add an additional class to the grade level of the siblings.(d) A parent may appeal the principal's classroom placement of twins or higher order multiples in the manner provided by school district policy.(e) For purposes of this section, "higher order multiples" means triplets, quadruplets, quintuplets or larger groups of siblings resulting from the same delivery.1949, March 10, P.L. 30, art.
