Section 274b - Sheriff's sales without inquisition of bonds not containing waiver; validation

Whenever prior to the act, approved the sixth day of May, one thousand nine hundred and twenty-nine (Pamphlet Laws, one thousand five hundred and fifty-seven), entitled "An act permitting the sale of mortgaged real estate under a judgment upon the bond accompanying such mortgage to be made by the sheriff upon a writ of fieri facias without inquisition and without any other writ," any sale of mortgaged real estate under a judgment upon the bonds, not containing a waiver of inquisition, accompanying such mortgage has been made by the sheriff upon a writ of fieri facias without inquisition, such sale shall be deemed and taken to be valid and effectual for all purposes: Provided, That the provisions of this act shall not apply to any instance where the validity of such sale has been made the subject of litigation prior to the approval of this act.
