Section 17138 - Restrictions upon activities of board members and employees(a) General rule.--A member of the board or an employee of the authority may not, concurrent with the service of the member or employee with the authority, be a party officer, public officer, public official, public employee or a member of the immediate family of a party officer, public officer or public official. This section may not apply to members of the board appointed under section 17132(b)(4), (5), (6), (7) and (8) (relating to board of authority).(b) Applicability.--The provisions of the act of October 4, 1978 (P.L.883, No.170), referred to as the Public Official and Employee Ethics Law, and the act of July 19, 1957 (P.L.1017, No.451), known as the State Adverse Interest Act, are made specifically applicable to board members, officers and employees of the authority. For the purposes of application of the referenced acts, employees of the authority shall be regarded as public employees of the Commonwealth, and officers or board members of the authority shall be regarded as public officials of the Commonwealth, regardless of if the employees receive compensation. The authority shall also be subject to 65 Pa.C.S. (relating to public officers) and the act of February 14, 2008 (P.L.6, No. 3), known as the Right-to-Know Law, relating to the inspection and copying of public records.Added by P.L.
