Section 807.080 - Driver competency testing certificates; rules; fees(1) The Department of Transportation may adopt rules and enter into contracts necessary for the regulation and certification of persons and organizations authorized to certify an individual's competency to safely operate a motor vehicle, including a commercial motor vehicle, on behalf of the department.(2) Rules adopted under this section may include, but are not limited to, the following: (a) Establishing methods and procedures for the testing of competency to operate different types of motor vehicles.(b) Establishing the manner and mechanism by which test results shall be sent to the department.(c) Establishing reasonable fees as part of any program for regulation created by the department under this section.(d) Establishing grounds for suspension, cancellation or revocation of a person's or organization's authorization to certify competency to operate motor vehicles.(e) Establishing requirements for records retention.(f) Establishing requirements for inspections of premises, investigations and monitoring, including covert monitoring, to ensure that testing is conducted in strict accord with rules adopted under this section.(g) Establishing bond and insurance requirements.(3) In adopting rules under this section, the department shall take into consideration the regulations and laws of the federal government.Amended by 2023 Ch. 400,§ 9, eff. 9/24/2023, op. 1/1/2024.1985 c.608 §36; 1989 c.636 §20; 2005 c. 649, § 9
