Section 731.074 - "Commercial liability insurance."(1) "Commercial liability insurance" means insurance for a business, professional, nonprofit or governmental entity against legal, contractual or assumed liability for death, injury or disability of any human, or for damage to property, arising out of acts or omissions in the course of the conduct of the entity.(2) "Commercial liability insurance" does not include the following lines of insurance or classes of business: (a) Marine and transportation insurance;(b) Wet marine and transportation insurance;(c) FAIR plans and automobile assigned risk insurance;(d) Workers' compensation and employers' liability insurance;(e) Nuclear liability insurance;(f) Fidelity and surety insurance;(g) Hazardous waste and environmental impairment insurance;(h) Aviation insurance; or(i) Commercial automobile insurance.(3) As used in this section, "commercial automobile" means a four wheel passenger or station wagon type of vehicle used as a public or private conveyance, including a motor vehicle of the utility, pickup, sedan delivery or panel truck type used for wholesale or retail delivery, and a farm truck.731.074 was added to and made a part of the Insurance Code but was not added to ORS chapter 731 or any series therein by legislative action.
