Section 413.105 - Deposit of reimbursements received for medical assistance expenditures

All sums of money recovered by or paid to the Oregon Health Authority as reimbursement for funds expended for medical assistance shall be paid into the Oregon Health Authority Fund established by ORS 413.101 and may be used for the provision and administration of medical assistance. However, the United States Government is entitled to a share of any amount received as its interest may appear, which shall be promptly paid to the United States Government.

413.105 to 413.151 were enacted into law by the Legislative Assembly but were not added to or made a part of ORS chapter 413 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.

Section 41, chapter 602, Oregon Laws 2023, provides:

Sec. 41. (1) Subject to subsection (2) of this section, the Department of Justice shall deposit proceeds from the Juul Settlement, plus any interest earned on such proceeds, into the Oregon Health Authority Fund established under ORS 413.101, to be expended for purposes consistent with the terms of the settlement.

(2) Before making the deposit under subsection (1) of this section, the Department of Justice shall deduct from the proceeds the amount of costs and expenses of the department associated with the settlement.

(3) As used in this section, "Juul Settlement" means the settlement between the State of Oregon and Juul Labs, Inc. announced on September 6, 2022, and any modifications thereto. [2023 c. 602, § 41]
