Section 308A.418 - Removal of designation upon request of city or county; requirements(1) The governing body of the city or county that requested designation under ORS 308A.415 may request that the State Fish and Wildlife Commission remove that designation.(2) The commission shall remove the designation if:(a) The city or county demonstrates that the designation creates an economic burden for the city or county; and(b) The commission finds that the economic burden is significant.(3) In making its determination under subsection (2) of this section, the commission shall give significant weight to the demonstration of economic burden made by the city or county.
