Section 226.520 - Definitions for ORS 226.510 to 226.640As used in ORS 226.510 to 226.640:
(1) "Abandoned cemetery" means a cemetery in which remains have not been interred in the last five years and: (a) That does not have a known owner;(b) For which the last known owner is deceased and the title was not conveyed; or(c) That was owned by an entity that no longer exists and that did not convey title.(2) "Cemetery" means a tract of land set apart by deed, will or otherwise, for a burial ground, or for the purpose of interring remains.(3) "Diligent search" means a search reasonably calculated to discover: (a) Graves from the existence of monuments, contour of land and terrain, fencing, curbing and other evidences of the location of graves; and(b) The location of remains and whether or not a given plot contains remains, for which it shall be sufficient to employ the method commonly known as probing.(4) "Municipal corporation" means the governing body of a city incorporated under the laws of this state.(5) "Remains" means the remains of a deceased person.(6) "Suitable location" means a cemetery, now in existence or hereafter established, including a portion of a cemetery subject to the provisions of ORS 226.510 to 226.640, where provision is made for the perpetual care and upkeep of the graves.Amended by 2017 Ch. 160,§ 4, eff. 5/25/2017, op. 1/1/2018.1953 c.298 §2; 2005 c. 22, § 173
