Section 565.4

Any manufacturer or distributor who has new motor vehicle or new powersports vehicle sales and service agreements with new motor vehicle or new powersports vehicle dealers in this state shall allow its dealers to offer consumers any remote software upgrade or change to vehicle functions and features to a new motor vehicle or new powersports vehicle which is of a line-make the dealer holds an active sales and service contract for, as any offered to consumers by the manufacturer or distributor, and such upgrade or change shall be available for an authorized dealer to offer to consumers at any time during the life cycle of the vehicle, and subject to the manufacturer or distributor's requirements, provided the same continues to be made available and offered to consumers in this state by the manufacturer or distributor. This section does not apply to remote software upgrades or changes administered at no cost to the consumer or related solely to the safety, regulatory requirements, cybersecurity, recall of a motor vehicle or powersports vehicle, Oklahoma Statutes, or federal statutes. Nothing in this section shall be construed to limit or impair a manufacturer or distributor's intellectual property rights, or to grant a new vehicle dealer authority to sell, copy, modify, or use the manufacturer's or distributor's intellectual property in a manner that has not been authorized by the manufacturer or distributor. Nothing in this section shall obligate a manufacturer, distributor, or other person to support or maintain any software or change to vehicle functions and features.
