Section 7-603 - Conflicting claims - Interpleader

If more than one person claims title or possession of the goods, the bailee is excused from delivery until the bailee has a reasonable time to ascertain the validity of the adverse claims or to commence an action for interpleader. The bailee may assert an interpleader either in defending an action for nondelivery of the goods or by original action.

Comment:

(1) This is substantially the same as former 2 O.S. §§ 9-75 and 9-76.

(2) This subsection was added by Oklahoma. It is not part of the official text of the Uniform Commercial Code.

The purpose of this addition is to secure an interpretation of interpleader consistent with the more liberal views, and not by the older and more rigid requirements that the title of the claimants be identical and of a common origin.
