(A) Except as provided in division (B) of this section, whoever violates this chapter or rules adopted under it is guilty of a misdemeanor of the third degree on a first offense, a misdemeanor of the second degree on a second offense, and a misdemeanor of the first degree on a third or subsequent offense.(B) A person who fails to comply with rules adopted under division (A)(2)(f) of section 905.322 of the Revised Code is not subject to division (A) of this section.Amended by 130th General Assembly File No. TBD, SB 150,§1, eff. 8/21/2014.Amended by 129th General AssemblyFile No.191,HB 420, §1, eff. 3/27/2013.Effective Date: 10-29-1996
