Section 5164.02 - Rules to implement chapter(A) The medicaid director shall adopt rules as necessary to implement this chapter. The rules shall be adopted in accordance with Chapter 119. of the Revised Code.(B) The rules shall establish all of the following:(1) The amount, duration, and scope of the medicaid services covered by the medicaid program;(2) The medicaid payment rate for each medicaid service or, in lieu of the rate, the method by which the rate is to be determined for each medicaid service;(3) Procedures for enforcing the rules adopted under this section that provide due process protections, including procedures for corrective action plans for, and imposing financial and administrative sanctions on, persons and government entities that violate the rules.(C) The rules may be different for different medicaid services.(D) The medicaid director is not required to adopt a rule establishing the medicaid payment rate for a medicaid service if the director adopts a rule establishing the method by which the rate is to be determined for the medicaid service and makes the rate available on the internet web site maintained by the department of medicaid.Amended by 132nd General Assembly File No. TBD, HB 49,§101.01, eff. 9/29/2017 (Vetoed Provisions).Renumbered from §5111.02 by 130th General Assembly File No. 25, HB 59,§101.01, eff. 9/29/2013.Effective Date: 06-26-2003; 06-30-2005
