Section 5104.019 - [Effective Until 1/1/2025] Adoption of rules governing the certification of in-home aidesThe director of job and family services shall adopt rules in accordance with Chapter 119. of the Revised Code governing the certification of in-home aides. The rules shall provide for safeguarding the health, safety, and welfare of children receiving publicly funded child care in their own home and shall include the following:
(A) Standards for ensuring that the child's home and the physical surroundings of the child's home are safe and sanitary, including physical environment, physical plant, and equipment;(B) Standards for the supervision, care, and discipline of children receiving publicly funded child care in their own home;(C) Standards for a program of activities, and for play equipment, materials, and supplies to enhance the development of each child; however, any educational curricula, philosophies, and methodologies that are developmentally appropriate and that enhance the social, emotional, intellectual, and physical development of each child shall be permissible;(D) Health care, first aid, and emergency procedures, procedures for the care of sick children, procedures for discipline and supervision of children, nutritional standards, and procedures for screening children and in-home aides, including any necessary physical examinations and immunizations;(E) Methods of encouraging parental participation and ensuring that the rights of children, parents, and in-home aides are protected and the responsibilities of parents and in-home aides are met;(F) Standards for the safe transport of children when under the care of in-home aides;(G) Procedures for issuing, renewing, denying, refusing to renew, or revoking certificates;(H) Procedures for inspection of homes of children receiving publicly funded child care in their own homes;(I) Procedures for record keeping and evaluation;(J) Procedures for receiving, recording, and responding to complaints;(K) Qualifications and training requirements for in-home aides;(L) Standards providing for the needs of children who have disabilities or who receive treatment for health conditions while the child is receiving publicly funded child care in the child's own home;(M) Any other procedures and standards necessary to carry out the provisions of this chapter regarding certification of in-home aides.Amended by 134th General Assembly File No. TBD, HB 281,§1, eff. 4/6/2023.Added by 129th General AssemblyFile No.128,SB 316, §120.01, eff. 1/1/2014.This section is set out more than once due to postponed, multiple, or conflicting amendments.
