Section 3901.80 - Insurance for living organ donors(A) As used in this section: (1) "Living organ donor" means a living person who donates an organ to another living person.(2) "Policy of insurance" means a life insurance policy, disability insurance policy, or long-term care insurance policy.(B) Notwithstanding any provision of law to the contrary, an insurer shall not unfairly discriminate against a living organ donor in the offering, issuance, premium, or conditions of a policy of insurance based solely, and without any additional actuarial risks, on that person's status as a living organ donor.(C) A violation of division (B) of this section shall be considered an unfair and deceptive practice in the business of insurance under section 3901.21 of the Revised Code.(D) The superintendent of insurance may adopt rules as necessary to carry out the requirements of this section.Added by 134th General Assembly, HB 188,§1, eff. 7/6/2022.
