Section 3323.022 - [Effective Until 1/1/2025] Staffing for programs with preschool children with disabilitiesThe rules of the department of education and workforce for staffing ratios for programs with preschool children with disabilities shall require the following:
(A) A full-time staff member shall be provided when there are eight full-day or sixteen half-day preschool children eligible for special education enrolled in a center-based preschool special education program.(B) Staff ratios of one teacher for every eight children shall be maintained at all times for a program with a center-based teacher, and a second adult shall be present when there are nine or more children, including nondisabled children enrolled in a class session.(C) Unless otherwise specified in the individualized education program, a minimum of ten hours of services per week shall be provided for each child served by a center-based teacher.Amended by 135th General Assembly, HB 33,§130.100, eff. 10/3/2023.Amended by 132nd General Assembly, SB 216,§1, eff. 11/2/2018.Added by 132nd General Assembly, HB 49,§101.01, eff. 9/29/2017.This section is set out more than once due to postponed, multiple, or conflicting amendments.
