Section 2323.33 - Action dismissed for want of security for costs; applicability(A) If security for costs is not given in a case mentioned in sections 2323.30 to 2323.32 of the Revised Code, at any time before the commencement of the trial, on motion of the defendant, and notice to the plaintiff, the court shall dismiss the action, unless in a reasonable time, which it may allow, security is given.(B) This section does not apply if a party makes an application under section 2323.30 or 2323.31 of the Revised Code to qualify as an indigent litigant as set forth in section 2323.311 of the Revised Code.Amended by 132nd General Assembly File No. TBD, HB 595,§1, eff. 3/22/2019.Effective Date: 10/1/1953 .
