Section 6-08.1-05 - Government access1. A governmental agency or law enforcement agency may obtain customer information from a financial institution pursuant to either of the following: a. The consent of the customer, in accordance with this chapter.b. Valid legal process, in accordance with this section.2. A governmental agency or law enforcement agency may obtain customer information from a financial institution pursuant to a judicial or administrative subpoena duces tecum served on the financial institution, if there is reason to believe that the customer information sought is relevant to a proper law enforcement objective or is otherwise authorized by law.3. A governmental agency or law enforcement agency may obtain customer information from a financial institution pursuant to a search warrant if it obtains the search warrant pursuant to the rules of criminal procedure of this state. Examination of the customer information may occur as soon as it is reasonably practicable after the warrant is served on the financial institution.
