Section 54-01-09.1 - [See Note] State offenses - Concurrent jurisdiction ceded to the United States

Concurrent jurisdiction is hereby ceded to the United States over offenses, as defined in section 12.1-01-04, when committed within boundaries of the tracts of land designated as:

1. Theodore Roosevelt national park.
2. Fort Union trading post national historic site.
3. Knife River Indian villages national historic site.

As provided by S.L. 1991, ch. 647, § 2, this section becomes effective on the date the Governor certifies to the Secretary of State and to the State Historical Board that the Congress of the United States has enacted legislation accepting the transfer of the Fort Totten State Historic Site to the United States for inclusion in the National Park System as a national historic site, and provides that the Secretary of State shall forward a copy of the Governor's certification to the Legislative Council, with a notation indicating the effective date of the Act.
